These Terms and Conditions govern the purchase of services from Duarte Business English. Please read them before booking. By purchasing a class or package, you agree to these terms.
- Who we are
These terms apply to services provided by Melissa B. Duarte, trading as Duarte Business English (“we”, “us”, “our”). Our full identifying details are set out in our Legal Notice. You can contact us at info@duartebusinessenglish.com
- The services we provide
We provide online Business English training. We currently offer:
One-on-one classes with Melissa, available as a single 50-minute session or as a package of 10 classes.
Group classes (when available), held in small groups and sold as a set of sessions.
Digital products. We also sell downloadable PDF guides, such as the Meeting Rescue Pack and English for Spanish Speakers. They are delivered as a download immediately after payment and are for your personal use only.
14-day guarantee on digital products. If a digital product does not help you, email us at info@duartebusinessenglish.com within 14 days of purchase and we will refund you in full. This guarantee is in addition to, and does not limit, your legal rights as a consumer.
The weekly group masterclass (monthly membership). The weekly group masterclass is a monthly membership: four live classes a month, 50 minutes each, on Google Meet, in a fixed weekly group at a time agreed with that group. Places are limited and groups are arranged by level. It is paid monthly in advance, starting on the day you pay your first month. Your monthly price stays the same for as long as your membership continues without a break.
Joining a group. Joining the waiting list is free and no payment is taken until you are offered a place and accept it. A group starts once 3 people have a confirmed place. If a group does not reach 3 people, it does not start, and we will offer you the next start date or private lessons instead.
Stopping your membership. You can stop at any time by email with two weeks’ notice. You will not be charged again after the notice period, and you keep your place until the end of the month you have paid for.
Missed classes. Missed classes are not refunded or carried over, but you receive the class materials and your written report, and you can send a voice note on the topic for personal feedback.
Right of withdrawal for the weekly group masterclass. You can withdraw within 14 days of your first payment. If you have asked us to start the sessions within that period, we will refund the part of your first month that has not yet been delivered.
Classes are delivered online via Google Meet. We recommend contacting us before purchase so we can confirm a schedule that suits you.
- Prices and payment
All prices are shown on our website in euros and are final prices, including any taxes that apply. Payment is made securely online through our payment provider, Stripe. Your booking is confirmed once your payment has been received and we have acknowledged it.
- Booking and scheduling
After your purchase, we will arrange class times with you by email. One-on-one classes are scheduled by mutual agreement and should be used within the validity period below. Group classes have a set schedule. It is your responsibility to attend at the agreed time and to have a working internet connection and device.
- Rescheduling and cancellations by you
If you need to reschedule a class, please give us at least 24 hours notice and we will do our best to offer an alternative time.
A class canceled or missed with less than 24 hours notice may be treated as used and may not be refundable or rescheduled.
Class packages are valid for 3 months from the date of purchase. Classes not used within this period may be forfeited.
- Right of withdrawal (cooling-off period)
Under EU consumer law, you generally have 14 days from the date of purchase to withdraw from an online purchase and receive a refund.
Because our classes are a service, if you ask us to begin providing the service (for example, to schedule or hold a class) within that 14-day period, you expressly request and agree that the service may start before the withdrawal period ends. Once a class or package has been fully delivered at your request, the right of withdrawal for that service is lost.
If you withdraw within 14 days and some classes have not yet been delivered, you will receive a refund for the undelivered classes, and we may charge for the value of any service already provided.
To withdraw, contact us at info@duartebusinessenglish.com within the 14-day period.
- Cancellations or changes by us
If we ever need to cancel or reschedule a class, we will offer you an alternative time.
- Refunds
Where a refund is due under these terms, it will be issued to your original payment method within 14 days.
- Conduct during classes
Our classes are a respectful, professional learning space. We reserve the right to end a class or to decline future bookings in the case of abusive, threatening, or inappropriate behavior.
- Intellectual property
Any materials we share with you during or for your classes are provided for your personal learning use only. You may not copy, share, distribute, or resell them.
- Our liability
We provide our services with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or unforeseeable losses. Nothing in these terms removes or limits your statutory rights as a consumer.
- Complaints and dispute resolution
If you have a complaint, please contact us first at info@duartebusinessenglish.com and we will do our best to resolve it. We are not currently signed up to any voluntary alternative dispute resolution scheme. If a matter cannot be resolved directly, you may be able to refer it to the competent Spanish consumer authorities.
- Governing law
These terms are governed by Spanish law. As a consumer, you continue to benefit from the mandatory protections of the law of your country of residence, and you may bring proceedings before the courts that apply to you under that law.
